The results of the trust effectiveness are often found in its administration. Attorneys have concerns about how a trust will be handled once the trust has been funded and responsibilities have passed to the trustee.

While advance directives are considered “ancillary documents” in the context of elder law and estate planning, the wishes they capture become central to clients as they near the end of their lives.
