Final Friday – November 2016

Recorded: November 18, 2016
Presented by Valerie L. Peterson, J.D.
and David Goldfarb, Public Policy Manager, NAELA
Duration: 58 minutes

This month’s Final Friday update will be a “special edition” focused on the election and what we might see in the coming months. We have extended the time of the webinar from 30 minutes to one hour so we have time to cover not only the election and what might happen in the area of elder law planning going forward, but also other news from around the country.

Agenda:

  1. Legal right to access bank accounts made them an available resource even though Medicaid applicant lacked the mental capacity to access the accounts. McGovern v. Arizona Health Care Cost Containment System Administration
  2. Attorney cannot claim attorney-client privilege to avoid testifying about undue influence involving a will prepared by that attorney. Vassallo v. Bean
  3. 2016 Election – What will the future hold?
