The First-Party Special Needs and Third-Party Supplemental Needs Trusts in ElderDocx® are powerful tools in helping families that would like to plan for their loved ones with disabilities and maintain their benefits. The First-Party Special Needs Trust allows clients with disabilities to remain eligible for public benefits while protecting their own assets. The Third-Party Supplemental Trust is a planning tool used to help family and friends leave a legacy for persons with disabilities.

Join ElderCounsel’s Law and Privacy Specialist, Jill Roamer, J.D., CIPP/US as she walks attendees through the differences in these trusts and the appropriate planning scenarios to use them. Then, she will dive into the ElderDocx drafting system to illustrate the various design options including:

  • Distribution standards and payback provision requirements in the First-Party Special Needs Trust;
  • Beneficiary Advocate options in the Third-Party Supplemental Needs Trust;
  • How to design a Medicare Set-Aside Subtrust and when you would need one;
  • Grantor trust rules and income taxation for both trusts; and
  • Qualified Disability Trust taxation in the Third-Party Supplemental Trust context

Jill will also review other tools a special needs planning attorney will use, such as pooled trusts, the Secure Supplemental Needs Trust, and ABLE accounts. This live drafting camp format allows attendees to learn the legal technical aspects of elder law planning within the practical context of drafting documents.

Webcast Requirements
This event requires a great deal of participation from attendees. We highly recommend attending in-person if at all possible. If you opt to attend via live webcast, we ask that you prepare accordingly by following the guidelines below:

  1. Be prepared to share your webcam. This will allow attendees and presenters to see you and more easily interact with you during the event.
  2. Be sure your Internet speed will support streaming the workshop.
    • You must have an Internet connection with a minimum speed of 10 Mbps. We strongly recommend a wired connection. You may learn your speed at www.speedtest.net.
    • A quiet place without interruptions
    • A working microphone
    • Google Chrome as your recommended browser
    • Close other applications and bandwidth heavy items such as cloud applications that require continuous syncing
    • Headphones are recommended for listening.
  3. If at all possible, make plans to participate from a location outside of your office. This event requires participation from attendees and if you are interrupted by work demands you (and other attendees) will not get the full benefit from the event and it will be disruptive for everyone.

Cancellation Policy: Any enrollee in an ElderCounsel course (excluding online courses in the Learning Center) that cancels:

  • More than 10 business days in advance of the start of the course will be eligible for a full refund;
  • Within 3-10 business days of the start of a course, will be charged a $250 cancellation fee; and
  • Less than 3 business days prior to the start of the course, will not receive a refund.
