Third party special needs trusts are often used by estate planning attorneys when drafting an estate plan for a (currently) healthy client, or when planning for loved ones who are, or may become disabled. However, there are numerous “traps” estate planning attorneys should be wary of when drafting third party special needs trusts – especially if the client actually needs a first party special needs trust. This session will cover how to identify and draft around “traps” in third party special needs trusts, as well as understanding when a first party special needs trust is necessary.
