Revocable living trusts (RLTs) are a cornerstone planning document for many families. The ElderCounsel RLT can be drafted according to your clients’ planning goals during their lifetime and instruct how they would like their assets to pass outside of the probate process when they pass away. The ElderCounsel RLT has unique design and tax options that pertain to elder and special needs planning as well. The trust is only one document in the larger RLT document set. There are a variety of supporting documents that are drafted in the software to correspond with the selections you make while designing the trust, such as the Companion Will and Funding Instructions.

In December 2022, the Consolidated Appropriations Act was signed into law that contained provisions known as SECURE 2.0 that will affect retirement outcomes in the near and far future.

The EC Veterans Asset Protection Trust® (VAPT) is designed to hold a Veteran’s assets in order to qualify for future pension benefits from the Department of Veterans Affairs (VA). It is a specially designed irrevocable trust that allows wartime veterans and their spouses to plan for their future care while protecting their property. This trust has both grantor and non-grantor subtrust options that were designed to comply with both VA qualification rules and the Internal Revenue Code.

The First-Party Special Needs and Third-Party Supplemental Needs Trusts in ElderDocx® are powerful tools in helping families that would like to plan for their loved ones with disabilities and maintain their benefits. The First-Party Special Needs Trust allows clients with disabilities to remain eligible for public benefits while protecting their own assets. The Third-Party Supplemental Trust is a planning tool used to help family and friends leave a legacy for persons with disabilities.
